Barth Law involvement in confidentiality lawsuit against RCMP leads roundup of the federal courts
Barth Law was in Federal Court this week, representing the plaintiff in a lawsuit against the RCMP for violation of a witness protection program. The court also heard suits involving personal injury, cargo damages, pension claims, and intellectual property, while McCarthy Tétrault, Gowling WLG (Canada) and Seastone IP represented the parties involved in a patent infringement suit in the Federal Court of Appeal.
Federal Court of Appeal
McCarthy Tétrault LLP acted for Farmers Edge Inc. in a patent infringement action against Farmobile LLC, which was represented by Gowling WLG (Canada) LLP and Seastone IP LLP.
An appeal from the judgement of the Tax Court of Canada involving a reassessment made under the Income Tax Act was also heard by the FCA. Schmidt & Gilmour Tax Law represented the plaintiff, Alexander Marino.
Thorsteinssons LLP acted for the plaintiff Sukhwinder Grewal in another tax case concerning an appeal from the judgement of the federal court upholding the decision of the Minister of National Revenue.
Federal Court
The RCMP was sued for alleged breach of the confidentiality provisions of the Witness Protection Program Act and for breach of duty of care it owed to the plaintiffs. The lawsuit was filed by Paul Derry, a long-term undercover agent and informant of the RCMP. Derry was represented by Barth Law.
In a personal injury lawsuit, Roebothan, McKay & Marshall appeared on behalf of Adam French and Martin, Whalen, Hennebury, Stamp acted for Norcon Marine Services Ltd. French filed a $50,000-suit against the defendant, alleging that he suffered injuries and damages because of the negligence of the defendant and its employees. French travelled on the defendant’s vessel and, as he was exiting, he slipped on the gangway of the vessel. He fell violently on the ground, causing serious personal injury.
In another personal injury action, League and Williams Law Corp. acted for Kyle Berkson against the Portuguese cargo ship, Helena G. Berkson was a stevedore and in the course of his employment when he was crushed by a heavy load of cargo which was in the process of being loaded and unloaded by the vessel’s on-board crane.
McInnes Cooper represented Crossby Molasses Company Ltd. in an admiralty action against the defendants, the Ship M/T “Scott Stuttgart,” Scot Stuttgart SA, Scot Tanker Holdings SA, and ED&F Man Liquid Products LLC. Crossby claimed that its cargoes of fancy and blackstrap molasses were contaminated by epoxy flakes from the ship’s tank coatings while it was onboard. The cargoes were loaded in San Jose, Guatemala and delivered to Crossby’s terminal in Saint John, New Brunswick. The defendants were represented by Borden Ladner Gervais LLP.
A proposed class proceeding was filed against the Minister of Veterans Affairs Canada, as the administrator of the Pension Act. The act sets out a regime for the provision of disability pension and other benefits to members and former members of the Canadian Armed Forces and the Royal Canadian Mounted Police. The proposed class proceeding involves allegations of systemic acts and omissions in the administration, operation, and management of the pension benefits program under the Person Act. Robert Marcus Hirschfield, the proposed representative plaintiff for the class, was represented by Murphy, Battista LLP.
In a patent infringement action, Goodmans LLP acted for Google against Sonos Inc., which was represented by Robic LLP.
Australian Mud Company also filed a patent infringement suit against Boart Longyear Group Inc. Gowling WLG (Canada) LLP acted for Australian Mud Company, while Bennett Jones LLP was the legal counsel of Boart Longyear Group.
